Privacy Policy

Lone Oak Payroll has created this privacy statement (“Statement”) in order to demonstrate our commitment to customer privacy. Privacy on the Lone Oak Payroll web site (the “Site”) is of great importance to us. Because we gather important information from our visitors and customers, we have established this Statement as a means to communicate our information gathering and dissemination practices. We reserve the right to change this Statement and will provide notification of the change at least thirty (30) business days prior to the change taking effect.

Collected Information

We require customers who register to use the services offered on our Site (collectively, the “Service”) to give us contact information, such as their name, company name, address, phone number, and e-mail address, and financial qualification and billing information, such as billing name and address, credit card number, and the number of users within the organization that will be using the Service. At the time you express interest in attaining additional information, or when you register for the Service, we may also ask for additional personal information, such as title, department name, fax number, or additional company information, such as annual revenues, number of employees, or industry. Customers can opt out of providing this additional information by not entering it when asked.

Lone Oak Payroll uses the information that we collect to set up the Service for individuals and their organizations. We may also use the information to contact customers to further discuss customer interest in our company, the Service that we provide, and to send information regarding our company or partners, such as promotions and events. Customers are invited to receive an email newsletter by providing an email address. Customer email addresses and any personal customer information will not be distributed or shared with third parties. Separately, customers are also asked to provide an email address when registering for the Service, in order to receive a username and password. We may also email information regarding updates to the Service or company, and will send a Customer Newsletter. Again, email will not be distributed or shared.

Except as we explicitly state at the time we request information, we do not disclose to third parties the information provided. All financial and billing information that we collect through the Site is used solely to check the qualifications of prospective customers and to bill for the Service. This billing information is not used by Lone Oak Payroll for marketing or promotional purposes. Lone Oak Payroll uses a third-party intermediary to manage the credit card processing. This intermediary is solely a link in the distribution chain, and is not permitted to store, retain, or use the information provided, except for the sole purpose of credit card processing. Other third parties, such as content providers, may provide content on the web Site but they are not permitted to collect any information nor does Lone Oak Payroll share user information with these parties.

Customers of the Service will be using the Site to host data and information (“Data”). Lone Oak Payroll will not review, share, distribute, print, or reference any such Data except as provided in the Lone Oak Payroll License Agreement, or as may be required by law. Individual records may at times be viewed or accessed only for the purpose of resolving a problem, support issue, or suspected violation of the License Agreement, or as may be required by law. Of course, customers are responsible for maintaining the confidentiality and security of their user registration and password.

Lone Oak Payroll may also collect certain information from visitors to and customers of the Site, such as Internet addresses. This information is logged to help diagnose technical problems, and to administer our Site in order to constantly improve the quality of the Service. We may also track and analyze non-identifying and aggregate usage and volume statistical information from our visitors and customers and provide such information to third parties.

You may request the personal information directly collected by Lone Oak Payroll about you. This request may be made either by (i) calling 651-452-0366 and asking to speak with Lone Oak Payroll’s legal department, or (ii) by emailing johnr [at] tempworks.com, with the email subject “Personal Information Request.” You may also request that Lone Oak Payroll dispose of any and all personal information directly collected by Lone Oak Payroll about you, except for personal information that is required by Lone Oak Payroll to (X) complete the transaction for which it was collected, (Y) maintain complete records regarding previously-completed transactions, (Z) comply with legal obligations.

Cookies

When you interact with the Lone Oak Payroll Website we strive to make that experience easy and meaningful. When you come to our Web site, our Web server sends a cookie to your computer. Cookies are files that Web browsers place on a computer’s hard drive and are used to tell us whether customers and visitors have visited the Site previously.

Standing alone, cookies do not identify you personally. They merely recognize your browser. Unless you choose to identify yourself to Lone Oak Payroll, either by responding to a promotional offer, opening an account, or registering for Freemium, you remain anonymous to Lone Oak Payroll. Cookies come in two flavors: session and persistent-based. Session cookies exist only during an online session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you’ve closed your browser or turned off your computer. They include such information as a unique identifier for your browser.

Lone Oak Payroll uses session cookies containing encrypted information to allow the system to uniquely identify you while you are logged in. This information allows Lone Oak Payroll to process your online transactions and requests. Session cookies help us make sure you are who you say you are after you’ve logged in and are required in order to use the Lone Oak Payroll application. Lone Oak Payroll uses persistent cookies, that only Lone Oak Payroll can read and use, to identify the fact that you are a Lone Oak Payroll customer or prior Lone Oak Payroll Website visitor (whatever the case may be). We are especially careful about the security and confidentiality of the information stored in persistent cookies. For example, we do not store account numbers or passwords in persistent cookies. Users who disable their Web browsers’ ability to accept cookies will be able to browse our Website but will not be able to successfully use our Service.

Third Party Cookies: We may from time to time engage third parties to track and analyze non-personally identifiable usage and volume statistical information from visitors to our website to help us administer our website and improve its quality. Such third parties may use cookies to help track visitor behavior. Such cookies will not be used to associate individual website visitors to any personally identifiable information. All data collected by such third parties on behalf of Lone Oak Payroll is used only to provide us with information on site usage and is not shared with any other third parties.

Third-Party Sites

The Site contains links to other web sites. Lone Oak Payroll is not responsible for the privacy practices or the content of these other web sites. Customers and visitors will need to check the policy statement of these others web sites to understand their policies. Customers and visitors who access a linked site may be disclosing their private information. It is the responsibility of the user to keep such information private and confidential.

Security

Our Site has security measures in place to help protect against the loss, misuse, and alteration of the Data under our control. When our Site is accessed using Netscape Navigator, or Microsoft Internet Explorer versions 5.5 or higher, Secure Socket Layer (SSL) technology protects information using both server authentication and data encryption to help ensure that Data is safe, secure, and available only to you. Lone Oak Payroll also implements an advanced security method based on dynamic data and encoded session identifications, and hosts the Site in a secure server environment that uses a firewall and other advanced technology to prevent interference or access from outside intruders. Finally, Lone Oak Payroll provides unique user names and passwords that must be entered each time a customer logs on. These safeguards help prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of Data.

Your California Privacy Rights:

The California Privacy Rights Act (“CPRA”) grants you the privacy rights described in this section, subject to certain limitations and exceptions:

  • Right to Notice. The right to know about how we collect, use, disclose, sell, or share your personal information. This policy is intended to satisfy that right.
  • Right to Access. The right to know and access what personal information we have collected about you, including the categories of personal information, the categories of sources from which your personal information is collected, the business of commercial purpose for collecting, selling, or sharing your personal information, the categories of third parties to whom we disclose your personal information, and the specific pieces of personal information that we have collected about you.
  • Right to Delete. The right to delete personal information that we have collected from you, subject to certain exceptions.
  • Right to Correct. The right to correct inaccurate personal information that we maintain about you.
  • Right to Opt Out.The right to opt-out of the sale or sharing of your personal information by us if we sell or share personal information.
  • Right to Limit.The right to limit the use or disclosure of your personal information by us to purposes permitted by the CPRA, if we use or disclose sensitive personal information.
  • Right to Non-Discrimination.The right not to be discriminated against for exercising any of the privacy rights in this section. We do not use the fact that you have exercised or requested to exercise any CPRA right for any purpose other than facilitating a response to your request.

Identity Verification Requirements:

You may submit a California privacy rights request using one of the designated methods outlined below. When submitting your request, you must provide us with certain information so that we may locate your personal information in our systems and distinguish it from the personal information of others. You may need to provide us with your name, email address, address, phone number, driver’s license number, or SSN, among other items, depending on the information you would like to access.

Once we receive your request, we will acknowledge receipt within 10 business days and provide additional information about our verification process and the processing of your request. We will try to process your request within 45 days of receiving it. If we need more time (up to 45 days), we will notify you of our need for additional time and explain the reason why we need more time prior to the end of the initial 45-day period.

We do not generally charge a fee to fulfill any of your requests under CPRA; however, we may charge a reasonable fee or refuse to act on requests that are manifestly unfounded or excessive, including repetitive requests. If we refuse to act on a request, we will notify you of the reason.

Exceptions:

Please note that the CPRA does not require us to search for personal information, or delete that information, if the information is needed to:

  • Complete the transaction for which the personal information was collected, provide a good or service requested by you, conduct activities reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between Lone Oak Payroll and you;
  • Ensure the security and integrity of information (such as detecting security incidents and protecting against and prosecuting malicious, deceptive, or illegal activity like fraud);
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, or ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the businesses’ deletion of the information is likely to render impossible or seriously impair the achievement of such research, if you have provided informed consent;
  • Enable solely internal uses that are reasonably aligned with a consumer’s expectations based on their relationship with Lone Oak Payroll; or
  • Comply with a legal obligation.

Additionally, we may retain your personal information in our backup or archive systems until the retention period of those systems expire, as permitted by the CPRA.

      • The Lone Oak Payroll website (specifically, Internet Protocol address information);

    • Lone Oak Payroll also collects from its prospective customers—to the extent necessary to initiate requests for credit and/or background checks to a third-party service provider—education, employment, employment history, and bank account information (as detailed in subdivision (e) of Section 1798.80 of the California Civil Code), as well as the other personal identifiers listed above.
  • Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies:
    • Lone Oak Payroll collects this category of information from the following sources:
      • Underwriting and sales forms, emails, and phone calls with customers and prospective customers;
    • Biometric information:
      • Lone Oak Payroll does not collect this category of personal information.
    • Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website application, or advertisement:
      • Lone Oak Payroll does not collect this category of personal information.
    • Geolocation data:
      • Lone Oak Payroll does not collect this category of personal information.
    • Audio, electronic, visual, thermal, olfactory, or similar information:
      • Lone Oak Payroll does not collect this category of personal information.
    • Professional or employment-related information:
      • Lone Oak Payroll collects from its prospective customers—to the extent necessary to initiate requests for credit and/or background checks to a third-party service provider—education, employment, employment history, and bank account information (as detailed in subdivision (e) of Section 1798.80 of the California Civil Code), as well as the other personal identifiers listed in subsection (a) above.
    • Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99):
      • Lone Oak Payroll does not collect this category of personal information.

A list of the categories of sensitive personal information Lone Oak Payroll has collected about consumers in the preceding 12 months is as follows:

  • A consumer’s social security, driver’s license, state identification card, or passport number:

      • HRCenter, as used during the onboarding process which occurs during underwriting and sales (encompassing all identifiers above).
    • A consumer’s precise geolocation:
      • Lone Oak Payroll has not collected this category of sensitive personal information in the preceding 12 months.
    • The processing of biometric data for the purpose of uniquely identifying a consumer:
      • Lone Oak Payroll has not collected this category of sensitive personal information in the preceding 12 months.
    • Personal information collected and analyzed concerning a consumer’s health:
      • Lone Oak Payroll has not collected this category of sensitive personal information in the preceding 12 months.

Lone Oak Payroll’s commercial purpose for the collection of consumer information is to better enable Lone Oak Payroll to understand its prospective customers’ invoice factoring or payroll service needs, and to deliver the solution(s) best-suited to the prospective customers based on these needs.

Lone Oak Payroll’s business purpose for the collection of the above information is to enable Lone Oak Payroll to function as an invoice factor and payroll processor as required by law, as well as to help ensure an effective, positive, and mutually-beneficial working relationship with its prospects and customers.

Lone Oak Payroll does not disclose consumers’ personal information or sensitive personal information to third parties, except to those categories of third parties who assist Lone Oak Payroll in its finalization and/or maintenance of the invoice factoring and/or payroll services relationship (e.g., background check providers and software providers).

  • Lone Oak Payroll has shared personal information and sensitive personal information to third parties who assist Lone Oak Payroll in its finalization and/or maintenance of the invoice factoring and/or payroll services relationship (e.g., background check providers and software providers) in the following categories:
  • Identifiers such as real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, professional or employment-related information (including information regarding the ownership interest(s) of a consumer in a business being contemplated to be factored for, or provided payroll services by, Lone Oak Payroll), and other similar identifiers.
  • Lone Oak Payroll has not disclosed any personal information or sensitive personal information about consumers for business purposes in the preceding 12 months.

Do Not Track

California law requires us to let you know how we respond to web browser Do Not Track (DNT) signals. Because there currently isn’t an industry or legal standard for recognizing or honoring DNT signals, we don’t respond to them at this time.

Lone Oak Payroll does not sell or share consumers’ personal information other than for purposes authorized by subdivision (a) of Section 1798.121 of the California Civil Code; accordingly, it has omitted the links titled “Do Not Sell or Share My Personal Information” and “Limit the Use of My Sensitive Personal Information.”
